仲裁法院初步判决有菲国仲裁管辖权

据《路透社》2015年10月30日和其他主要媒体报道，国际常设仲裁法院于周四发布仲裁案初步判决，认为该法庭按照《海洋公约》有权受理菲律宾仲裁中国南海主权争议管辖权。尽管中国拒绝参与仲裁程序缺席，仲裁法庭正式接受并考虑了中国通过立场书的辩论，但驳斥中国政府的缺少管辖权的辩论立场。

 

《纽约时报》2015年10月30日的评论： “中国说仲裁庭没有管辖权并拒绝参与仲裁程序。但是海洋公约说仲裁庭的判决是有约束力的。现在法庭已经判决了这个程序问题，法庭后面要研究中国对南海海域主权主张。中国是否接受仲裁结果将展现这个国家如何看待自己在国际法上的信义。”  （China says the court has no jurisdiction and refuses to participate in the proceedings. The law of the sea treaty, however, says the tribunal’s verdicts are binding. Now that the court has decided the procedural question, it will examine the substantive merits of China’s sweeping claims to most of the South China Sea. Whether China accepts the outcome will say a lot about how it views its commitments under international law.)
